Cryptocurrency Laws in Brazil: Complete 2026 Guide
โ Legal & RegulatedIs Cryptocurrency Legal in Brazil?
Brazil is one of Latin America's most crypto-friendly major economies. The Cryptoassets Framework Law (Lei 14.478/2022), signed in December 2022 and effective from June 2023, established a comprehensive licensing regime for virtual-asset service providers (VASPs) in Brazil. Brazilians may legally buy, hold, trade, and use cryptocurrency, and the country has one of the world's largest crypto-user bases per capita.
Three regulators share responsibility. The Comissรฃo de Valores Mobiliรกrios (CVM) supervises securities-token activity and certain investment-type tokens. The Banco Central do Brasil (BCB) regulates payment-token activity, stablecoins, and the broader VASP licensing regime under Law 14.478. The Receita Federal (federal tax authority) administers tax. The result is a relatively clear three-pillar framework: CVM for securities, BCB for everything else operational, RF for tax.
Brazil has been at the forefront of CBDC development with the Drex (formerly Real Digital) project, currently in advanced pilot. The country also has a notable institutional crypto market, with B3 (the Sรฃo Paulo stock exchange) listing Bitcoin and Ether ETFs since 2021, and a large universe of Brazilian crypto exchanges (Mercado Bitcoin, Foxbit, NovaDAX) alongside global platforms.
Regulatory Framework
The Cryptoassets Framework Law's implementation is led by the BCB. From mid-2024 the BCB has been issuing detailed regulations on VASP authorisation requirements โ operational, prudential, AML, and consumer protection. Existing exchanges had a transitional period to obtain authorisation; the framework is being phased in through 2025.
The Receita Federal requires crypto activity to be reported via the dedicated Anexo de Criptoativos in the annual return. Holdings above R$5,000 on foreign platforms must be declared monthly via the Receita's digital reporting system. This is one of the most detailed crypto reporting regimes globally.
Crypto Exchanges in Brazil
Mercado Bitcoin (the largest Brazilian exchange by volume), Foxbit, and NovaDAX are domestic platforms. Global exchanges accessible to Brazilians include Binance, OKX, Crypto.com, Bitso (which acquired several Latin American operations), Coinbase, and Kraken. PIX integration (Brazil's instant payment system) is universal for domestic platforms, enabling fast fiat on/off ramps.
