Is Cryptocurrency Legal in Spain?

Cryptocurrency is legal in Spain and operates within a framework that combines Spanish national rules with the broader EU MiCA regime effective from December 2024. Spanish residents may legally buy, hold, trade, and use cryptocurrency. The Comisión Nacional del Mercado de Valores (CNMV) and Banco de España (BdE) supervise crypto-related financial activity. The Agencia Tributaria (the Spanish tax authority) administers tax.

Spain has been an early adopter of mandatory crypto reporting. Modelo 721 — introduced in 2023 — requires Spanish tax residents to declare holdings of cryptoassets on foreign platforms when total value exceeds €50,000. The combination of Modelo 721, Modelo 720 (for foreign assets generally), and the standard income tax return creates one of the most detailed crypto reporting regimes in Europe.

MiCA implementation in Spain harmonises the previous national VASP register (administered by Banco de España) with the EU-wide CASP regime. Existing Spanish-registered firms transition to MiCA authorisation through the July 2026 deadline.

Regulatory Framework

Banco de España maintains a register of crypto service providers under 5AMLD. The CNMV oversees securities-token activity. From December 2024 the CNMV is the principal MiCA conduct regulator for CASPs operating in Spain.

Spanish promotion rules are notably strict. The CNMV's 2022 Circular 1/2022 imposed detailed advertising rules for crypto-asset promotions, requiring risk warnings, prohibitions on certain claims, and CNMV pre-approval for mass-market campaigns.

Bit2Me (Spanish, MiCA CASP) is the dominant local platform. Binance, Coinbase, Kraken, Bitstamp, Crypto.com, and OKX all serve Spanish residents under MiCA authorisation. Spanish banking integration is generally permissive for transfers to authorised platforms.
